Charles Murray - By The People

An intellectual morass of okay-ish ideas and an overwhelming desire to not be seen as racist pervades this writing of Charles Murray.

His plan is to found a defense fund (the Madison Fund, as he calls it) for those who partake in civil disobedience.  He then creates copious rules and few examples of what the fund would actually defend.  In practice it would be indistinguishable from defense funds like the HSLDA.  IE, his idea exists in areas where it is already plausible and there is a reason it does not exist for anything else.  We don't want it because we don't want a libertarian utopia distopia of billions of individual contracts to sort for even the smallest of misunderstandings.

The chapter A Necessary Crisis starts out thusly

    "In which I discuss the possibility that the courts can be brought to realize that they founded the regulatory state on false premises, that they must meet their obligation to undo some of the damage they have caused, and that doing so will require a broader reform of civil litigation."

He is so concerned with these possibilities that he never thought that American people may just be done with their government.  He is trying to save something that neither the rulers nor the common people want.  In fact, he then goes on to describe how we can live in a united diversity.  He bases the following on his spurious reading of Albion's Seed (an excellent book on the 4 distinct cultures that formed America).  

     "Americans at the founding, Federalist and Anti-Federalist alike, demanded a Constitution that severely restricted federal power not just because of an abstract attachment to federalism or because of the single issue of slavery but because of the many concrete ways in which peoples with different ways of life didn't want a government that would interfere with those ways of life."

This only works if these outside groups give a shit about NOT interfereing with another group's way of life.  I believe almost all cultural groups demonstrably do not.  Any culture that is worth it's ancestor's blood sweat and tears will not accept these other cultures that actively war against them.
